Happy Workplaces has always prioritized the protection of personal privacy and has maintained the confidentiality of each survey respondent since it was founded in 2002, unless an individual user consents to the release of their Personal Information or individual results. Happy Workplaces also safeguards the identity of individuals who access its websites. In this Privacy Statement, the terms “Happy Workplaces,” “we,” “us,” and “our” refer to Happy Workplaces, Inc. and its subsidiaries and affiliates. I. HAPPY WORKPLACES WEBSITES’ INFORMATION COLLECTION

When you visit Happy Workplaces websites, we collect information in two ways: (1) indirectly through the use of our site’s technology and (2) directly when you voluntarily provide information on various pages.

1. Indirect Information Collection

Happy Workplaces collects various types of information indirectly through your use of our websites. This information may include browser and device information, data obtained through automated electronic interactions, application usage data, content information based on your interests, demographic information, geographic or geo-location information, and statistical and aggregated information (referred to as “Other Information”).

Statistical or aggregated information does not directly identify a specific individual, but it may be derived from Personal Information. For example, we may use Personal Information to calculate the percentage of users in a specific ZIP code. If we combine Other Information with Personal Information, we will consider the combined information as Personal Information.

 

1.1 Happy Workplaces Cookies

Certain types of indirectly collected information are stored as “cookies.” These are small files of electronic information that a website can transfer to a visitor’s hard drive to improve the visitor’s experience on the site. There are different types of cookies:

– Essential cookies provide visitors with basic functions on our websites. Without these cookies, our websites will not work properly.
– Analytics cookies collect information through statistics. This information helps us understand how our visitors use our websites.
– Marketing cookies help us improve the ads we display on third-party websites and allow third parties to gather web-usage information needed to determine ad performance.

The use of cookies is common on the internet. Most web browsers automatically accept cookies, but you have the option to accept or decline cookies by way of consent. You may adjust your browser settings to prevent the reception of cookies, or to receive notification whenever a cookie is sent to you. If you choose to reject cookies, please note that you may not be able to access the full functionality of Happy Workplaces websites. Cookies placed by Happy Workplaces will expire when the user terminates the website session or after a reasonable period of inactivity.

1.1.a. Tracking Data And Third-Party Analytics Providers

Tracking Data refers to website traffic volume and patterns, such as the number of daily visitors to a website or a particular page. Happy Workplaces indirectly collects this type of information through means such as an IP address, which is a number assigned to your device when you browse the internet. When you visit Happy Workplaces websites, our servers log your device’s IP address.

To obtain this Tracking Data, Happy Workplaces uses third-party analytics providers, such as Google Analytics. These providers use cookies to help us analyze how users use our websites. The information generated by the cookie, including your IP address, will be transmitted to and stored by the third-party analytics provider’s servers. The provider will use this information to evaluate your use of Happy Workplaces websites, compile reports on website activity, and provide other services related to website activity. The provider will not associate your IP address with any other data they hold.

 

Happy Workplaces uses IP anonymization to truncate or anonymize the last octet of the IP address for Member States of the European Union and other parties to the Agreement on the European Economic Area. In exceptional cases, the full IP address is sent to and shortened by Google servers in the USA.

 

Only designated Happy Workplaces administrators can access the information gathered by Google Analytics, which is used for administrative and planning purposes to improve the content and customize the layout of the site for individuals or groups of users. Happy Workplaces provides information about each cookie used on its website, and users can prevent the collection and use of information collected by the cookie by downloading and installing the browser plug-in available on the website. 1.1.b. Cookies for Advertising

We may engage third-party advertising companies to serve ads on our behalf. These companies may use cookies and action tags to measure the effectiveness of the ads they serve. You can choose whether or not to accept these cookies by providing your consent. You can adjust your browser settings to prevent the reception of third-party cookies, or to receive notification whenever such cookies are sent to you. If you choose not to accept these cookies, we will not be able to show you personalized content and ads.

2. Information Collected Directly

In addition to indirectly collected information, Happy Workplaces also collects Personal Information and other information that users voluntarily provide. It is entirely up to you whether or not to provide this information.

 

Happy Workplaces treats all directly collected information as confidential and uses it only for the particular purpose stated at the point of collection. We will seek your permission before using this information for any additional purpose. You can request that this information be removed at any time.

 

2.1. User Account Data

When creating a User Account on any of the Happy Workplaces websites, you may be asked to provide Personal Information, such as your name, email address, and phone number. If you choose to purchase any products, services, access codes, or other items for sale from Happy Workplaces, you will be asked to provide payment details and your full address for billing purposes.

As a customer or user of Happy Workplaces, we may collect Personal Information about you when you register to use our websites or services/products, or when you provide feedback about our products or services. We will use your Personal Information to provide the products and services you request, communicate with you about your account or transactions, and provide support, such as product updates, patches, and fixes.

Additionally, we will use your Personal Information to notify you about site features, new product releases, and service developments, and to advertise Happy Workplaces’s products and services in accordance with this Privacy Statement.

 

Your User Account data will be stored only until you decide to terminate your account. If we are required by law to further store your Personal Information due to statutory retention requirements, your Personal Information will be stored only until such retention periods expire.

 

2.2. Other Personal Information Provided Directly

Personal Information provided by you on Happy Workplaces websites, such as through contact forms or via telephone, will be stored in our service database and retained for the period necessary to fulfill our contractual obligations to you. This is in accordance with Article 6 (1) 1 lit. b) GDPR, unless a longer retention period is required by law.

 

II. DATA COLLECTION

Many Happy Workplaces websites provide users with the opportunity to participate in surveys or assessments online. The purpose and process for each survey or assessment will be provided to users as part of the relevant survey or assessment.

 

1. Access to Your Survey or Assessment Results From Another User Account

If another online user purchases a Happy Workplaces access code for you to participate in a survey or assessment, that user will be able to access your results. The data accessible to the account holder may include your name and results, but not your specific answers to individual questions. The account holder cannot modify, alter, or delete any of your results or User Account data.
After completing the survey or assessment, you will have the option to change your settings for sharing your results with other account holders and to opt out of sharing your results.

 

2. Sharing Your Survey Results With Others

After completing a survey or assessment, you may have the option to share your results via email or social media. Only your name and results will be displayed. By sharing your information from your User Account with a social media service, you authorize us to share information we collect from and about you with the social media service provider, other users, and your network of contacts on the social media service. You understand that the social media service’s use of the shared information will be governed by its Privacy Policy. If you do not want your Personal Information shared in this way, please do not connect your Happy Workplaces information to a social media service provider.

III. GENERAL INFORMATION ON COLLECTION AND PROCESSING OF INFORMATION

1. Correcting and Changing User Information and Preferences; Deletion of User Accounts

If you have given your consent to receiving email communications from Happy Workplaces but wish to withdraw your consent and discontinue this service, you may do so at any time by contacting us (see also below clause III.7. “Your Rights”). Registered users can also change their settings within their User Account under “MY ACCOUNT” by updating their “Contact Me” settings.
You have the option at all times to delete your User Account for any Happy Workplaces website or request a revision of your user information. To do so, please contact us.

 

2. Information Security

Happy Workplaces takes reasonable and appropriate security procedures to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the Personal Information. We have appointed a Privacy Policy Administrator to monitor privacy practices. Access to user data is strictly limited to specific individuals who are trained to respect user privacy. A log of those who accessed the data is maintained and monitored to prevent security breaches. However, no security measure or modality of data transmission over the internet is 100% secure. Although we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee absolute security.

 

3. Third-Party Information Storage

We provide Personal Information to our affiliates and trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Statement and any other appropriate confidentiality and security measures. For example, we use service providers such as Amazon cloud for data storage. Any vendor or agent that we retain is not allowed to use Personal Information they receive from us for any other purpose than to perform the contracted services we have contracted them to perform.

 

4. Children and Privacy

Happy Workplaces encourages parents and guardians to spend time with their children online and to be fully familiar with the sites visited by their children. Happy Workplaces websites do not contain content that is generally considered unsuitable for children.

 

5. Links to Other Sites

Happy Workplaces websites may contain links to sites owned and/or operated by other organizations, and the Privacy Policies of those sites may differ from that of Happy Workplaces. These sites may collect data and make use of it in ways that Happy Workplaces does not. We encourage you to review the Privacy Policies posted on all third-party sites.

 

6. Location of Data Collection and Processing and Storage

By accessing Happy Workplaces websites, you may be submitting Personal Information and survey or assessment results that Happy Workplaces will use for business purposes that are consistent with this Privacy Statement. As a worldwide organization, Happy Workplaces collects information that may be processed internationally throughout Happy Workplaces offices worldwide. Your information may be processed in the United States or any other country in which Happy Workplaces maintains facilities, including any Happy Workplaces subsidiary. Happy Workplaces retains Personal Information gathered and processed for the purposes described in this Privacy Statement for as long as there is a business purpose for doing so. Please refer to clauses I.2.1 and I.2.2 above for more information on how we retain your Personal Information.

 

7. Your Rights

You are entitled to access your Personal Information held by Happy Workplaces and request to correct, update, amend, suppress, delete or otherwise modify any inaccurate Personal Information. We may ask you to verify your identity before acting on your request. If you are subject to GDPR, you may also object to the use or processing of your Personal Information or withdraw consent to use it at any time. Under GDPR, you have the following rights regarding the processing of your Personal Information:

 

– You have the right to receive free information about whether your Personal Information is retained and to access, duplicate, or receive a copy of your retained Personal Information. However, if your request affects the rights and freedoms of others or is manifestly unfounded or excessive, we may charge a reasonable fee or refuse to act on the request.
– You have the right to request the proper rectification, removal or restriction of your Personal Information.
– If your Personal Information is processed based on your consent or is necessary for the performance of a contract with you, and processing is carried out by automated means, you have the right to receive the Personal Information concerning you in a structured, commonly used and machine-readable format or to have your Personal Information transmitted directly to another company, where technically feasible (data portability).
– If your Personal Information is processed based on your consent, you have the right to withdraw your consent at any time without affecting the processing activities that took place before such withdrawal or to any other existing legal justification of the processing activity in question.
– You have the right not to be subject to any automatic individual decisions that produce legal effects on you or similarly significantly affect you.
– You have the right to take legal actions in relation to any breach of your rights regarding the processing of Personal Information, as well as to lodge complaints before the competent data protection regulators.

 

To exercise any of these rights, please contact us at info@happyworkplaces.com. If we process your Personal Information on the basis of our legitimate interests pursuant to Art. 6 (1) lit. f) GDPR, you may object to processing at any time. You may find the detailed description of our processing activities and the legal basis in the sections before. If you object, we will no longer process your Personal Information unless there are compelling and prevailing legitimate grounds for the processing or the data are necessary for the establishment, exercise, or defense of legal claims. If you object to such processing, please state the grounds of your objection for us to examine the processing of your Personal Information and decide whether to adjust the processing accordingly. We obtain your consent before sharing your Personal Information with any third party that is not acting as an agent or vendor to perform tasks on our behalf or to use the information for a purpose materially different from the purpose for which it was initially collected or subsequently authorized by you. An exception to this will be (among others) where Happy Workplaces’s processing of Personal Information is necessary for compliance with a legal obligation under the applicable law.

 

8. Sensitive Information

If we process your sensitive information (such as medical information, Personal Information revealing ethnic or racial origin, political opinions, religious or philosophical beliefs, trade union membership, the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or a natural’s person sex life or sexual orientation), we will obtain your consent, or where legally required, your explicit consent.

Happy Workplaces may not be required to obtain explicit consent under GDPR regarding sensitive information if the processing is (a) necessary to protect the vital interests of the data subject or another natural person where the data subject is physically or legally incapable of giving consent; (b) necessary for the establishment, exercise or defense of legal claims, or whenever courts are acting in their judicial capacity; (c) necessary to carry out Happy Workplaces’s obligations in the field of employment law as authorized by European Union or Member State Law or a collective agreement pursuant to Member State Law providing for appropriate safeguards for the fundamental rights and the interests of the data subject; or (d) related to information that is manifestly made public by the individual.

 

9. Dispute Resolution

If you have any complaints regarding our compliance with this Privacy Statement, you should first contact us. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with this Policy.
In terms of human resources data, Happy Workplaces will cooperate and comply with the EU DPA’s and the Swiss Federal Data Protection and Information Commissioner (FDPIC) and the advice provided by such authorities with regard to human resources data transferred from the EU and Switzerland in the context of the employment relationship. If Happy Workplaces does not acknowledge your complaint promptly or fails to address it to your satisfaction, you may contact the EU DPA’s for more information or to file a complaint. These services are provided at no cost to you.
Happy Workplaces is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

 

10. “Do Not Track” Signals

Some internet browsers have a “Do Not Track” feature that signals to the websites you visit that you do not want to have your online activity tracked. Since there is no uniform way that browsers communicate the “Do Not Track” signal, the Happy Workplaces websites do not currently interpret, respond to, or alter their practices when they receive “Do Not Track” signals.

 

11. Notice for Nevada Residents

If you are a Nevada resident, you have the right to opt out of the sale of certain types of personal information as defined by Nevada law, which means the exchange of personal information for monetary consideration to another person, subject to some exceptions. At present, we do not sell personal information as defined by Nevada law. However, if you are a Nevada resident, you may submit a verified request to opt out of sales, and we will record your instructions and include them in our policy if it changes in the future. 12. Notice for California Residents

This Privacy Notice for California Residents pertains solely to all visitors, users, and others who live in California (“consumers” or “you”), and it supplements the information provided in Happy Workplaces’s Privacy Statement. We have adopted this notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2022 (“CCPA”), and any CCPA-defined terms have the same meaning when used in this notice.

 

INFORMATION WE COLLECT

Websites operated by Happy Workplaces collect personal information from consumers that identifies, relates to, describes, references, or could reasonably be linked to them or their household. The categories of personal information that the Websites collected from consumers over the past 12 months are as follows:

 

A. Identifiers: includes real name, postal address, unique personal identifier, online identifier, IP address, email address, account name, Social Security number, driver’s license number, passport number, or other similar identifiers. YES

Personal information listed in the California Customer Records statute: includes name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Protected classification characteristics under California or federal law: includes age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). D. Commercial information: includes records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. YES

Biometric information: includes genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints and voiceprints, iris or retina scans, keystroke, gait or other physical patterns, and sleep, health or exercise data. F. Internet or other similar network activity: includes browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement. YES

 

G. Geolocation data: includes physical location or movements. NO

 

H. Sensory data: includes audio, electronic, visual, thermal, olfactory or similar information. NO

 

I. Professional or employment-related information: includes current or past job history or performance evaluations. YES

 

J. Nonpublic education information: includes education records directly related to a student, maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information or student disciplinary records. NO

 

K. Inferences drawn from other personal information: includes profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. YES

 

L. Sensitive Personal Information: includes personal information that reveals: (a) a consumer’s social security, driver’s license, state identification card, or passport number; (b) a consumer’s account login, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) a consumer’s precise geolocation; (d) a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (e) the contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication; (f) a consumer’s genetic data; (g) the processing of biometric information for the purpose of uniquely identifying a consumer; (h) personal information collected and analyzed concerning a consumer’s health; (i) personal information collected and analyzed concerning a consumer’s sex life or sexual orientation. Retaining Personal Information:
We will keep your personal information for as long as necessary to fulfill the purposes for which we collect it, as stated in this Privacy Statement, and to comply with any legal, accounting, or reporting obligations that apply to us.

For example, if you share your name and contact information to ask a question about our products or services, we will use that personal information to respond to your inquiry. Disclosure of Personal Information for a Business Purpose

Happy Workplaces may disclose your personal information for a business purpose. When we disclose personal information for a business purpose, we enter a contract that outlines the purpose and requires the recipient to keep that personal information confidential and not use it for any purpose except performing the contract.

 

In the preceding 12 months, Happy Workplaces has disclosed the following categories of personal information for a business purpose to one or more of the parties identified above:

Disclosure Of Personal Information

Happy Workplaces has shared personal information of Category F, which includes internet or other similar network activity, with advertising networks for commercial purposes in the preceding twelve (12) months.

 

We share your personal information to advance our commercial or economic interests, which may involve inducing you to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or effecting, directly or indirectly, a commercial transaction. The personal information shared falls under the category of internet or other similar network activity.

 

We share your personal information with advertising networks to better serve you with targeted advertising that matches your interests and preferences.

YOUR RIGHTS AND CHOICES

If you are a California resident, you have certain rights under the CCPA that relate to your personal information. This section outlines those rights and how you can exercise them.

 

RIGHT TO ACCESS AND DATA PORTABILITY
You have the right to ask Happy Workplaces to disclose certain information to you about how we collect and use your personal information. Once we receive and verify your request (as explained in Exercising Access, Data Portability, Deletion, and Correction Rights), we will disclose the following to you:

RIGHT TO DELETION

You are entitled to request that Happy Workplaces delete any personal information collected from you and retained, except in certain circumstances. Upon receiving and verifying your request, we will remove your personal information from our records, and we will instruct our service providers to do the same, unless an exception applies. We may refuse to honor your request if retaining the information is necessary for us or our service provider(s) to:
• Complete the transaction or provide a good or service that you requested or take other actions reasonably expected within the context of our business relationship with you, or otherwise perform our contract with you.
• Ensure the security and integrity of the information to the extent reasonably necessary and proportional for those purposes.
• Identify and repair errors in products that impair their intended functionality.
• Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
• Conduct public or peer-reviewed scientific, historical, or statistical research that complies with all applicable ethics and privacy laws, provided that your deletion of the information would render it impossible or seriously impair the research’s ability to proceed, provided that you previously gave informed consent.
• Enable internal uses that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which the information was provided.
• Comply with a legal obligation.

 

RIGHT TO CORRECTION

You have the right to request that we correct any inaccurate personal information that we hold about you, considering the nature of the data and the reasons for processing it. Upon receipt and verification of your request (see Exercising Access, Data Portability, Deletion, and Correction Rights), we will make commercially reasonable efforts to correct the inaccurate information.

 

EXERCISING ACCESS, DATA PORTABILITY, DELETION, AND CORRECTION RIGHTS

To exercise your access, data portability, deletion, and correction rights, you need to submit a verifiable consumer request to us through email: info@happyworkplaces.com Only you or an authorized representative can make a verifiable consumer request about your personal information. If you want to make a request on behalf of your minor child, you can do so. Please note that you can only make two requests within a 12-month period for access or data portability. Your verifiable consumer request must:

 

Provide enough information to allow us to verify your identity or that of your authorized representative. Describe your request with sufficient detail to enable us to understand, assess, and respond to it appropriately.

We cannot respond to your request or provide you with personal information unless we can verify your identity or authority to make the request, and confirm that the personal information relates to you.

 

Creating an account with us is not necessary to make a verifiable consumer request. We will only use the personal information provided in the request to verify the identity of the requester or their authority to make the request.

 

VERIFICATION OF IDENTITY

Before taking any action on an individual’s account, our Client Support Team is responsible for verifying the person’s identity. The team will use information that you have previously provided to verify your identity.

 

Happy Workplaces may ask for any of the following information to verify your identity:
– First and last name
– Email address or username
– Security questions and answers

RESPONSE TIMING AND FORMAT

We aim to respond to your verifiable consumer request within 45 days of receiving it. If we need more time (up to 90 days), we will explain why and the extension period in writing. We will provide our written response to your account with us, if you have one. If you do not have an account with us, we will deliver our written response by mail or electronically as per your preference. Our response will include an explanation if we are unable to comply with your request. For data portability requests, we will provide your personal information in a format that is easily usable and enables you to transmit it from one entity to another without difficulty. We will not charge you a fee to process or respond to your verifiable consumer request, except in cases where it is repetitive, excessive or manifestly unfounded. If we determine that a fee is necessary, we will provide you with a cost estimate and explain the reasons for it.

 

RIGHT TO OPT OUT OF SALE OR SHARING OF PERSONAL INFORMATION

If you are 16 years old or older, you have the right to instruct us not to sell or share your personal information at any time (the “right to opt out”). We do not sell or share the personal information of consumers whom we know to be under 16 years of age, unless we receive affirmative authorization (the “right to opt in”) from the consumer who is at least 13 but not yet 16 years of age, or from the parent or guardian of a consumer under 13 years of age. Consumers who opt in to personal information sales or shares may opt out of future sales or shares at any time. To exercise the right to opt out, you (or your authorized representative) may submit a request to us by emailing privacy@happyplacetowork.net. If you have enabled privacy controls on your browser (such as a plug-in), we will also consider it a valid request to opt out of sales.

 

NONDISCRIMINATION

We will not treat you unfairly for exercising any of your CCPA rights. We will not:

– Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
– Provide you a different level or quality of goods or services.
– Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain CCPA-permitted financial incentives that may result in different prices, rates or quality levels. These financial incentives will reasonably reflect the value of your personal information and will contain written terms that outline the program’s essential aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
